Issuance of Industrial Licence

Overview

All manufacturing enterprises are required to have an Industrial License before commencement of operations. The licence is renewed annually on or before the date of first licence issue. These licences are issued by the Industrial Licensing Authority (ILA) and the Regional Licensing Committees.

Who is eligible?

Any enterprise registered in Botswana and individuals who are above the age of 18 years. However, the following activities are reserved for citizens of Botswana or for companies that are wholly owned by citizens of Botswana if on a small scale or as a joint venture on medium/large scale;

How do I get this service?

For enterprises with a turnover of more than P5 million, completed forms are submitted to the Department of Industrial Affairs,

For enterprises with a turnover of less that P5 million, completed forms are submitted to the District/Town/City Council Commercial Office in your locality.

  • Download and complete the appropriate application form, submit with supporting documents to the Department of Industrial affairs or District/Town/City council commercial offices  :
  1. Application form for industrial licence  – initial application of an industrial licence
  2. Application to manufacture a new product
  3. Application to manufacture at an additional place
  4. Application to change location
  5. Application to transfer an industrial licence to another enterprise
  6. Application to pay annual fee
  • ​The application will be considered by the Industrial Licencing Authority (ILA) Board (at Headquarters) or the Licensing Committee (at District/Town/City Council), and the applicant will be notified of the outcome via mail, phone or SMS.
  • If the licence has been approved, the applicant can collect the licence from the office they applied at upon payment of applicable fees.

  1. Pay administration fee
  2. A copy of the Certificate of Incorporation
  3. Shareholding documents
  4. Additional Information sheet (collected with the application form)
  5. An Environmental Impact Assessment Report/Authorisation letter from the Department of Environmental Affairs
  6. Approval/clearance/recommendation from Environmental Health from the Local authority/council
  7. An approval/authorisation letter from Physical planning office
  8. Lease agreement/proof of plot ownership
  9. Copies of national  identity card/passport for both foreign and citizen shareholders
  10. Commitment letter from a licensed waste carrier and a valid copy of the waste carrier’s license or proof of payment for waste collection from the council
  11. Provide clearance/recommendation/authorisation letter from; 

-Environmental & Occupational Health Division (Ministry of Health & Wellness) for Chemicals

-Ministry of Agriculture and Food Security for animal and plant related products feeds

-Nutrition and Food Control (Ministry of Health and Wellness) for food and beverages

 

  • Application to manufacture a new product:
  1. Additional Information Sheet (collected with the application form)
  2. An Environmental Impact Assessment Report/Authorisation letter from the Department of Environmental Affairs
  3. Approval/clearance/recommendation from Environmental Health from the Local authority/council

  • Application to transfer a Licence:
  1. Completion of form AIL 1 in duplicate by the transferee
  2. Certificate of Incorporation of the transferee
  3. Shareholding documents of the transferee
  4. Commitment letter from a licensed waste carrier and a valid copy of the waste carrier’s license or proof of payment for waste collection from the council
  5. Proof of last payment
  6. Pay administration fee
  7.  If transfer is to a different location also include;
  • Environmental health recommendation/authorisation letter
  • An approval/authorisation letter from Physical Planning Office
  • An Environmental Impact Assessment Report/Authorisation letter from the Department of Environmental Affairs
  • Lease agreement/proof of plot ownership

Consumer Education

Overview

Consumer responsibility is the key to every consumers’ right. It is the responsibility of every consumer to act responsibly as the Consumer Protection Office alone would not defeat the injustices that exist in the markets.

Consumers must exercise responsibility as they go about making decisions in market places. This include but not limited to familiarizing themselves with terms of contracts before binding themselves with agreements.

Consumer must be aware of their rights and seek protection from relevant authorities if they feel their rights are been violated.

Business Education

Businesses must familiarize their staff with consumer protection laws such as the Consumer Protection Act and capacitate them on good customer service and have within their internal processes, clear consumer complaints resolution mechanisms.

Unethical business practices cannot be tolerated, and it is every business’ responsibility to ensure good customer welfare through market offerings.  This include but not limited to fair advertising, issuance of receipts, good complaints management and good customer care among others.

Issuance of Economic Diversification Drive (EDD) Certificate

Overview

To coordinate all efforts aimed at diversifying the country’s sources of economic growth and income in such a way that the country becomes more or less equally dependent on all sectors of the economy through the implementation of the Economic Diversification Drive (EDD) Short-term Strategy and the EDD Medium to Long-term Strategy.

Who is eligible?

Businesses registered in Botswana engaged in manufacturing, service provision (excluding agents/ distributors/retailers/resellers etc.) and agricultural production.

How do I get this service?
  • Fill in and submit the application form to register under the EDD Initiative to register online (Confirm link) or
  • Download, complete and submit the EDD Application Form with supporting documents to the nearest Department of Industrial Affairs (DIA).
  • ​The applicant will be notified of the outcome via SMS.
  • Collect EDD Certificate

  • Certified copy of a valid relevant license/ Registration Certificate or the letter of waiver

How do I get this service?
  • Download and complete the appropriate application forms, submit with supporting documents to the Town or District Council commercial affairs offices listed below;
  1. Application Form for Trade Licence  – Initial application of trade licence.
  2. Notice Form of Intention to Transfer a Trade Licence – To transfer the trade license to another individual or company, or to notify of the change in operating location.
  3. Application Form for a Transfer of a Trade Licence To transfer the trade licence to another individual or company, or to notify of the change in operating location..
  4. Licence Annual Fee Payment Form.
  5. Application Form for a Duplicate licence​ – To apply for a licence after the original has been lost or destroyed subject to the submission of a valid police report. ​
  • If the license has been approved, the applicant will be notified of the result via mail, phone or SMS to collect the license from Town or District council commercial affairs offices upon payment of applicable licence fees.
  • On or before the anniversary date of the license grant, the applicant has to submit Trade License Annual Fee Payment Form and the applicable fees to the Town or District council commercial affairs offices.
What supporting documents are required?

 New application:

  • If the applicant is a business, a copy of the certificate of incorporation.
  • If the applicant is an individual or a partnership, submit a certified registration certificate.
  • The latest copy of the annual returns form obtained from the Registrar of Companies and Intellectual Property.
  • Proof of availability of the business premises (either a title deed, or a written lease agreement).
  • A certified copy of a valid National Identity card (Omang) for owners, shareholders or directors who are citizens.
  • Certified copy of passport for owners, shareholders or directors who are non-citizens.
  • The original or certified copy of physical planner's report validating zoning for the plot upon which the activities will occur. Physical planners are employed by the District Council and should be booked by the applicants to validate zoning.
  • The original or a certified copy of the environmental health report for the business premises in question. The report must be completed by health inspectors employed by the District Council and the applicant must book the health inspector for inspection.

Transfer of license:

  • A certified copy of a valid National Identity card (Omang) for owners, shareholders or directors who are citizens.
  • Certified copy of passport, work and residence permit for owners, shareholders or directors who are non-citizens.

Annual License fee:

  • Latest Company Annual Returns form (* only where applicable).
  • A certified copy of a valid National Identity card (Omang) /passports of directors and shareholders (*only if there have been changes to directors and shareholding).

Duplicate license:

  • Police report indicating the licence has been stolen or destroyed.
