Request for Beacon Re-identification

Overview

This is a service which is accorded to plot owners who have been shown their plot boundaries and cannot identify them on their own. The applicant submits an application to the Board for re-identification.

Application for Mining Surface Rights

Overview

This is an application where applicants are granted surface rights by the Land Board to venture into mining. These include but not limited to the following; Gravel, river sand, quarry, gemstones, copper etc. The applicant applies and obtains a prospecting license from the department of mines. Armed with this license, the applicant identifies suitable areas for the mining. The incumbent submits an application to the board which assess the application for availability of the land. The surface rights run simultaneously with mining permit from Department of mines.

What supporting documents are required?
  • Certified copy of valid National Identification Card (Omang)
  • Letter of representation (For Societies/Churches/Business) or Power of attorney in case of companies
  • Copy of Certificate of Incorporation, Company Registration and Shares Certificate for registered Companies
  • Copy of Certificate of Registration from Registrar of Societies for Societies
  • Letter of consultation from neighboring land users/community
  • Locality sketch plan
  • Copy of award of tender (in case contractors, the grant is tied to the duration of the contract).
  • Copy of Instrument signed under Married Persons Property Act (proof of Marriage regime if married and Affidavit if not married)
  • Decree absolute and court order where applicable
  • Copy of Death Certificate, in case of widow/widower

Transfer of Land Rights

Overview

The process involves the transfer of already acquired land rights to another person or entity. The said plot should be fully developed.  In the event, the plot is not fully developed, the applicant should avail reasonable justification as to why it should be transferred.

  • Motswana
  • Non-citizen with the consent of the Minister responsible for Land Management
  • Registered company/societies.

What supporting documents are required?
  • Certified copy of valid National Identification Card (Omang) from both parties
  • Original certificate of grant or lease agreement
  • Copy of Instrument signed under Married Persons Property Act (proof of Marriage regime if married and Affidavit if not married)
  • Decree absolute and court order where applicable
  • Copy of Death Certificate, in case of widow/widower,
  • Copy of Disability Card, in case of People Living with disability (PLWD)
  • Copy of Certificate of Incorporation, Company Registration and Shares Certificate for registered Companies
  • Copy of Certificate of Registration from Registrar of Societies for Societies
  • Letter of representation (For Societies/Churches/Business) or Power of attorney in case of companies

Application for Change of Land Use

Overview

This is a process of changing the use of land granted by Land Board to a different use. One can change from single residential to multi residential and/or business plot such as commercial, industrial etc. arable fields can also be changed to commercial such as integrated farming, feedlot etc’

Complete Application for Customary Land Rights Form or Application for Common Land Rights Form (Customary/common law depending on the intended use).

What supporting documents are required?
  • No outstanding lease rentals for common law plots
  • Certified and valid copy of Omang/ID
  • Copy of marriage certificate (if not married Affidavit confirming marital status for business plots)
  • Copy of Instrument signed under Married Persons Property Act (Marriage In/Out of community of property)

Request for Consolidation/ Sub Division

Overview

This is the process of dividing or combining two or more plots. The end product is multiple title or one that encloses all plot areas combined. 

Who is eligible?

Holders of the land title.

How do I get this service?

This service is applied at the District Council. Once approved the applicant submits the approval letter to the Land Board for issuance of the new title.

What supporting documents are required?
  • Complete Customary / Common Law Land Rights application form
  • Certified copy of ID’s (Omang)
  • Locality sketch plan
  • Copies of certificates/ leases of the plot/ploughing field
  • Letter of representation (For societies/syndicates/Business / Companies
  • Site plan(s)

No payment, unless there is the desire to convert to common law lease whereat the costs are  outlined under conversions.
